…but would have everything to fear from its union with either of the other departments. This, according to Publius (Alexander Hamilton) in Federalist Paper #78, and a lesson Obama’s Justice Department takes every opportunity to use to their advantage.

The WaPo is reporting that Obama’s DoJ can’t seem to get enough of standing against the 10th amendment to the Constitution:

The Justice Department filed another lawsuit against immigration practices by Arizona authorities, saying Monday that a network of community colleges acted illegally in requiring noncitizens to provide their green cards before they could be hired for jobs.

In Monday’s lawsuit, Justice officials said the colleges discriminated against nearly 250 noncitizen job applicants by mandating that they fill out more documents than required by law to prove their eligibility to work. That violated the federal Immigration and Nationality Act, the department said.

The law’s anti-discrimination provision “makes it unlawful to treat authorized workers differently during the hiring process based on their citizenship status,” said Thomas E. Perez, assistant attorney general for Justice’s Civil Rights Division. He said the government “is acting now to remedy this pattern or practice of discrimination.”

It is lost on most of us how it can be that asking for a green card where a proof of citizenship or guest worker eligibility is required by law has somehow now become discrimination. How are we to even KNOW if these folks are authorized workers if we don’t obtain some sort of documented proof. Remember, in other States around the country there have been a large number of raids where illegals have been caught and arrested and employers fined. Is the DoJ asking Arizona to do exactly that which it is prosecuting other States for doing?

Alexander Hamilton’s observation in Federalist paper #78 rings no more true than when used as a backdrop to the earlier suit Obama’s administration filed against Arizona, successfully blocking the implementation of a law strongly supported by residents of the State…and strongly backed by other States across the country…in large and clear numbers. In joining up with the President and his DoJ agenda to soften immigration law enforcement, Judges like the one that caved to the pressures from the Executive branch help show that a lack of an independent Judiciary is a guarantee that the death of Liberty is not far behind.
